1. WHO WE ARE

This website is operated by PM Company Digital LLC, a limited liability company organized under the laws of the State of Florida, United States, State ID L26000355164, with its principal place of business at 15442 Ventura Blvd, Ste 201-2746, Sherman Oaks, CA 91403, United States. We trade as Alassio Grey.

In these Terms, "we", "us" and "our" mean PM Company Digital LLC. "You" means anyone who visits or buys from alassiogrey.com.

We are an independent retailer. We are not an authorized dealer, official distributor or contractual partner of any other brand, unless expressly stated in writing on this website.


2. ACCEPTANCE OF THESE TERMS

By browsing, registering or placing an order on this website, you agree to these Terms and to our Privacy Policy, Returns and Refunds Policy and Shipping and Delivery Policy, which form part of this agreement.

If you do not agree with any part of these Terms, please do not use this website.

Nothing in these Terms affects your statutory rights as a consumer.


3. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into binding contracts to buy from us. By placing an order you confirm that this is the case and that all information you provide is accurate, current and complete.


4. YOUR ACCOUNT

Some features require an account. You are responsible for keeping your login details confidential and for all activity under your account. You may not transfer, sell or share your account. If you suspect unauthorized use, tell us immediately at contact@alassiogrey.com.


5. PRODUCTS AND DESCRIPTIONS

We take care to describe our products accurately, including materials, dimensions and sizing.

Product images are illustrative. Colour and finish may appear slightly different on your screen depending on your device, its display settings and ambient lighting. Manufacturers may also update packaging without notice. These variations are normal and do not make a product faulty.

This does not affect your rights if an item arrives faulty, damaged, incorrect or materially different from its description. Those rights are set out in our Returns and Refunds Policy.

All products we sell are genuine and sourced from reputable suppliers.

Product descriptions are subject to change without notice. We may discontinue any product at any time and may limit quantities available to any person or region.


6. PRICES AND PAYMENT

Prices are displayed in US dollars (USD) for customers in the United States and in pounds sterling (GBP) for customers in the United Kingdom, and apply only to purchases made on this website.

Delivery is free on every order, with no minimum spend. Any duties, import taxes or customs fees on international orders are covered by us. There are no handling fees, subscription fees or recurring charges of any kind. The total displayed at checkout is the total you pay.

Applicable sales tax is calculated and displayed at checkout before you complete your purchase, where required by law.

We accept payment by credit and debit card through Shopify Payments, our secure checkout provider. Available card types are shown at checkout. We do not currently offer instalment plans.

Prices may change at any time without notice. The price that applies to your order is the one displayed when you place it and confirmed in your order confirmation email.

If your card is issued in a currency other than the one shown, your bank may apply a conversion rate and a foreign transaction fee. These are set by your bank, are not collected by us, and are not part of the total shown at checkout.

You confirm that the payment details you provide are accurate, that you are authorized to use the payment method, and that sufficient funds are available.


7. HOW A CONTRACT IS FORMED

Your order is an offer to buy. A contract is formed only when we send you an email confirming that your order has been accepted and dispatched.

We may decline or cancel an order in the following circumstances:

  • The item is out of stock
  • There has been an obvious and demonstrable pricing or description error
  • Payment is not authorized by your card issuer
  • We reasonably suspect fraud or unauthorized use of a payment method
  • The delivery address is in an area our carriers do not serve
  • The quantity ordered suggests purchase for resale rather than personal use

In any of these cases we contact you by email and refund in full any amount already taken.


8. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes have their own terms, duration and availability, set out when they are published. Unless expressly stated, they cannot be combined.

Codes are for personal use, are not transferable, have no cash value and may be withdrawn in cases of misuse or fraud.

Items bought on promotion carry exactly the same statutory and contractual rights as items bought at full price.


9. DELIVERY

Delivery times, methods and dispatch origins are set out in our Shipping and Delivery Policy, which forms part of these Terms.

All delivery times are good faith estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, incorrect address details supplied by you, or events outside our reasonable control.

Goods remain at our risk until they are delivered to you.


10. CANCELLATION AND RETURNS

You have 30 days from delivery to return an item for any reason, and we pay return shipping in every case.

If you are in the United Kingdom, you also have a statutory right to cancel within 14 days of receiving your goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving any reason, with a further 14 days to return them and reimbursement within 14 days.

11. FAULTY GOODS

If an item is faulty, damaged or not as described, contact us within 30 days of delivery and we will replace it or refund you in full, at your choice, at no cost to you.

If you are in the United Kingdom, the Consumer Rights Act 2015 gives you a short-term right to reject within 30 days, and thereafter a right to repair, replacement, price reduction or final rejection. Nothing in these Terms limits those rights.


12. ACCEPTABLE USE

You may use this website for lawful purposes only. You must not:

  • Use the website for any unlawful or fraudulent purpose
  • Provide false information or use another person's payment details without authorization
  • Copy, reproduce, distribute or commercially exploit any part of this website without written permission
  • Use robots, scrapers, data mining tools or any automated means to access the website
  • Attempt to bypass, disable or circumvent any security measure
  • Introduce viruses, malware or any harmful code
  • Harass, threaten or abuse our staff or other users

We may suspend or terminate access where these rules are broken, without prejudice to any other remedy.


13. INTELLECTUAL PROPERTY

All content on this website, including text, images, photographs, graphics, layout, design and source code, belongs to PM Company Digital LLC or its licensors and is protected by United States and international intellectual property law.

You may view and use this website for personal, non-commercial purposes only.

Third-party trademarks shown on this website remain the property of their respective owners and appear only to identify the products offered. Their appearance does not imply any affiliation, authorization or endorsement.

If you believe any content here infringes your rights, contact us at contact@alassiogrey.com and we will investigate promptly.


14. REVIEWS AND USER CONTENT

Reviews published on this website reflect the personal opinions of the customers who wrote them.

We do not write, buy or incentivize fake reviews, and we do not remove genuine reviews simply because they are unfavourable. We may remove content that is unlawful, abusive, obscene, off-topic or infringes the rights of others.

By submitting content you grant us a free, non-exclusive licence to display it on this website, and you confirm that you own the rights to it.


15. ERRORS AND OMISSIONS

This website may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, availability or delivery times.

We may correct such errors and update information at any time, including after an order has been submitted. Where a correction means cancelling an order, we notify you and refund in full.


16. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY US OR REQUIRED BY LAW, THIS WEBSITE AND THE PRODUCTS OFFERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THIS WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you. This disclaimer concerns the operation of the website and does not affect your statutory rights regarding the goods you buy.


17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THIS WEBSITE OR ANY PRODUCT PURCHASED THROUGH IT.

We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any breach of your statutory rights.

If you are in the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill.


18. EVENTS OUTSIDE OUR CONTROL

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including severe weather, industrial action, carrier failure, customs delays, government action, power failures and failures of internet or telecommunications infrastructure.


19. DATA PROTECTION

How we handle personal data is set out in our Privacy Policy, which covers our obligations under the California Consumer Privacy Act as amended, the UK GDPR and the Data Protection Act 2018.


20. THIRD-PARTY LINKS

This website may link to third-party sites. We do not control them, do not endorse them and accept no responsibility for their content or practices. Visiting them is at your own risk.


21. OUR PLATFORM PROVIDER

This store runs on Shopify, which provides the ecommerce platform and payment processing. All sales are made directly with PM Company Digital LLC. Shopify is not responsible for any aspect of the sale between you and us.


22. COMPLAINTS

If you are unhappy with anything, contact us first at contact@alassiogrey.com. We aim to resolve complaints quickly and directly.

If you are in the United Kingdom and we cannot resolve matters to your satisfaction, you can seek free advice from Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk, or contact your local Trading Standards service.


23. GENERAL

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in full force.

Our failure to enforce any right does not amount to a waiver of that right.

These Terms, together with the policies referenced in them, form the entire agreement between us regarding your use of this website.

You may not transfer your rights under these Terms without our written consent. We may transfer ours, provided this does not affect your rights.


24. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our practices, our products or the law. The current version is always available on this page with the date of the last update. Changes take effect from publication and do not apply retrospectively to orders already placed.


25. GOVERNING LAW

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

If you are a consumer resident in the United Kingdom, nothing in these Terms deprives you of the protection of mandatory consumer law of your country of residence, and you may bring proceedings in the courts of the United Kingdom.
